6. File Sharing and Access Permissions

NFC Vault may provide tools to share files and folders with other people or organizations.

You are responsible for managing sharing permissions and ensuring that shared content is accessible only to authorized recipients.

If you use NFC Vault for business or regulated data, you must assess whether the Service, your subscription, your configuration, and any applicable contractual arrangements meet your legal and operational requirements.

8. Prohibited System and Network Activities

You must not use NFC Vault in a way that places unreasonable load on the Service or interferes with its normal operation.

Prohibited activities include:

  • Deliberately overwhelming the Service with excessive or abusive requests.

  • Use free or trial access to circumvent payment obligations or subscription restrictions.

Organization administrators are responsible for managing authorized users, promptly removing access when users leave, and ensuring that organizational accounts are used in accordance with the applicable subscription.

10. High-Risk and Restricted Uses

You must not rely on NFC Vault for activities where a failure, interruption, loss of access, or data corruption could reasonably be expected to cause death, personal injury, or severe physical or environmental damage, unless we have expressly agreed in writing to support that use and the necessary safeguards are in place.

Examples may include certain life-critical systems, emergency-response infrastructure, and safety-critical industrial control systems.

You are responsible for evaluating whether NFC Vault is suitable for your intended use. A feature's technical availability does not by itself mean that it has been designed, certified, or approved for a regulated or safety-critical purpose.

Additional restrictions may apply under your subscription, applicable law, or a separate written agreement.

11. Copyright and Intellectual Property Complaints

We respect intellectual property rights and expect customers to do the same.

If you believe that content stored or shared through NFC Vault infringes your copyright or other intellectual property rights, contact us with sufficient information for us to assess the complaint.

Where applicable, include:

  • Identification of the protected work or right you believe has been infringed.
  • Identification of the relevant file, shared link, or location, with enough detail for us to locate it.
  • An explanation of the alleged infringement.
  • Evidence that you own the relevant right or are authorized to act for the rights holder.
  • Any additional information reasonably required to evaluate the complaint.

Send complaints to info@netforchoice.com, using the subject line “Intellectual Property Complaint.”

We may request additional information, restrict access to disputed content, notify the relevant account holder where appropriate, or take other action consistent with applicable law.

Knowingly submitting false or misleading complaints may have legal consequences.

12. Reporting Abuse or Security Incidents

If you believe that NFC Vault is being used for unlawful activity, malware distribution, phishing, unauthorized access, or another violation of this Policy, please contact us.

Abuse and security reports: info@netforchoice.com

Where possible, include:

  • The relevant file, folder, or shared-link details.
  • A description of the suspected violation.
  • The approximate date and time of the activity.
  • Any relevant supporting information that can help us investigate.

Do not include passwords, private encryption keys, or unnecessary sensitive personal information in your report.

We may ask for further details before taking action. Submitting a report does not guarantee that a particular outcome or timeline will apply.

13. Monitoring, Investigation, and Enforcement

To protect the Service, comply with legal obligations, and enforce this Policy, we may investigate credible reports and relevant indicators of suspected abuse.

Where technically available, contractually permitted, and legally appropriate, we may use security systems, abuse reports, access logs, metadata, malware-detection tools, and other proportionate measures to identify suspicious activity.

We do not promise to review every file or monitor all Customer Content continuously. The absence of detection or intervention does not constitute approval of prohibited activity.

Depending on the circumstances, we may:

  • Request information or cooperation from the account holder.
  • Issue a warning or require corrective action.
  • Restrict access to a file, folder, shared link, or specific feature.
  • Temporarily suspend an account or user.
  • Disable access to content that presents a credible legal or security risk.
  • Suspend or terminate the Service in accordance with our Terms and Conditions.
  • Preserve or disclose relevant information where legally required or permitted.
  • Notify appropriate authorities where required by law or reasonably necessary to address serious unlawful activity.

Where reasonably practicable and legally permitted, we will provide notice and an opportunity to resolve the issue before taking significant action. Immediate action may be necessary where there is an urgent security threat, serious abuse, or legal obligation.

We will seek to make enforcement decisions proportionate to the nature, severity, and recurrence of the violation.

14. Appeals and Review Requests

If you believe that we restricted or suspended your account, file, or sharing feature in error, you may contact our support team at info@netforchoice.com.

Please provide your account details, a description of the action taken, and the reasons you believe the action should be reviewed.

We may request additional information to verify your identity, assess the issue, or determine whether the reported activity violated this Policy.

We will review requests where reasonably practicable, subject to legal requirements, security considerations, and the need to protect other users.

A review request does not automatically restore access or suspend a restriction while the review is pending.

15. Responsibilities of Organization Administrators

If you administer an organizational NFC Vault account, you are responsible for taking reasonable steps to ensure that your users understand and comply with this Policy.

Your responsibilities may include:

  • Granting access only to authorized users.
  • Managing account permissions and shared links.
  • Removing access when users no longer require it.
  • Responding to suspected misuse by users under your administration.
  • Maintaining appropriate internal security and data-handling procedures.
  • Ensuring that your organization's use of the Service complies with applicable law and its contractual obligations.

These responsibilities apply in addition to any obligations set out in your subscription or separate written agreement.

16. Consequences of Violations

Violations of this Policy may result in one or more of the following actions, depending on the circumstances:

  • A warning or request to correct the issue.
  • Removal or restriction of access to prohibited content.
  • Suspension of sharing links or specific functionality.
  • Temporary suspension of an account.
  • Termination of an account or subscription.
  • Refusal of future access to the Service where lawful.
  • Referral to law enforcement or relevant authorities where appropriate or legally required.

Any suspension, termination, payment consequences, or data-handling measures will be subject to our Terms and Conditions, applicable policies, written agreements, and mandatory law.

We will not interpret this Policy as granting unrestricted authority to access Customer Content or disclose customer information.

17. Relationship with Other Policies

This AUP supplements the NFC Vault Terms and Conditions and Privacy Policy.

Where applicable, customers may also be subject to a Refund and Cancellation Policy, Data Processing Agreement, Service Level Agreement, or other written service-specific agreement.

If there is a conflict between this Policy and a separately signed agreement, the signed agreement will govern to the extent specified in that agreement, subject to applicable law.

18. Changes to This Policy

We may update this AUP from time to time to reflect changes in the Service, security practices, legal requirements, or abuse-prevention measures.

We will update the “Last Updated” date when changes are made and take reasonable steps to notify customers of material changes where appropriate.

Your continued use of the Service after an updated Policy takes effect constitutes acceptance of the updated terms only to the extent permitted by applicable law.

If you do not agree with an update, you should stop using the affected Service and review any cancellation rights available under your subscription terms.
